Cheating is defined as obtaining or attempting to obtain, or aiding another to obtain credit for work, or any improvement in evaluation of performance, by any dishonest or deceptive means.

Kaufman, University of Florida 1 ____________________________________________________________________________ Abstract - In today’s goal driven society, cheating has become more prevalent among college students. These students first look for ways to cheat in secondary school and continue unethical practices in college. Some universities have implemented an honor code to hold students responsible for academic honesty. Researchers have investigated factors associated with college students and cheating that include personal and situational characteristics of this group of individuals, the influence of technological advances, and even influences from realms outside of academia. Many professionals in higher education argue that teaching students to behave in ethical ways and to develop core values that will influence lifelong decisions must become priorities. ____________________________________________________________________________ cheating on college campuses has been increasing in the last decade. It is a problem because of its frequency and because students are sacrificing their education for what they think are indicators of success. “Success” is often measured by whether a student has a passing grade on a written assignment, exam, or quiz, or passes a course that leads to graduation rather than the ability to complete an assignment, exam, or a course with integrity. Throughout the literature, academic dishonesty has been defined in many different ways. An all inclusive definition would be the practice of students giving or receiving unauthorized assistance in academic assignments, or receiving credit for work which is not their own. More simply, academic dishonesty consists of acts of cheating and plagiarism. In general, cheating is described as any of a variety of unethical behaviors.

Deceptive Credentials/ Cheating on Examinations: Cheating on examinations is definitely a violation of geneivat da'at. Both the teacher of the course and future employers who rely on grades to determine the abilities of potential employees have been deceived. Rabbi Moshe Feinstein (Igros Moshe, Choshen Mishpat 2: 30) and Rabbi Menashe Klein (Mishna Halacha 7: 275) make it clear that cheating on tests given in secular studies is prohibited.

(א) אסור להונות בדברים ולגנוב דעת הבריות ולרמות במקח וממכר ובו כ סעיפים:
כשם שאונאה במקח וממכר כך אונאה בדברים וגדולה אונאת דברים מאונאת ממון שזה ניתן להשבון וזה לא ניתן להשבון זה בגופו וזה בממונו והצועק על אונאת דברים נענה מיד: הגה וי"א דאין מצווין על אונאת דברים אלא ליראי השם (נ"י פרק הזהב) ומי שמאנה את עצמו מותר להוניהו (שם בשם המדרש):

His dishonesty and deceit in pretending to have accomplished something he has not is for his own personal benefit. Nevertheless, Rabbi Feinstein (Igrot Moshe, Choshen Mishpat, Siman 30) insists that cheating on exams is גנבת דעת and, as such, is explicitly forbidden by the Torah.

Rabbi Feinstein gives two other grounds for the prohibition of dishonesty in exams: first, it is against the law, Dina deMalchuta. Jews are required by Halacha to obey the law of the land and cheating is against the law. Second, there exists another Biblical prohibition because cheating on exams may lead to the stealing of money. If an employer hires a person because of the person’s outstanding grades, not knowing that these grades were accomplished through deceit, the employer will pay top money to a person who does not deserve it. The person is, in effect, taking money which does not belong to him.
