(א) אֵיזֶהוּ נֶשֶׁךְ וְאֵיזֶהוּ תַרְבִּית. אֵיזֶהוּ נֶשֶׁךְ. הַמַּלְוֶה סֶלַע בַּחֲמִשָּׁה דִינָרִין, סָאתַיִם חִטִּין בְּשָׁלשׁ, מִפְּנֵי שֶׁהוּא נוֹשֵׁךְ. וְאֵיזֶהוּ תַרְבִּית, הַמַּרְבֶּה בְּפֵרוֹת. כֵּיצַד. לָקַח הֵימֶנּוּ חִטִּין בְּדִינַר זָהָב הַכּוֹר, וְכֵן הַשַּׁעַר, עָמְדוּ חִטִּין בִּשְׁלשִׁים דִּינָרִין, אָמַר לוֹ תֶּן לִי חִטַּי, שֶׁאֲנִי רוֹצֶה לְמָכְרָן וְלִקַּח בָּהֶן יָיִן. אָמַר לוֹ הֲרֵי חִטֶּיךָ עֲשׂוּיוֹת עָלַי בִּשְׁלשִׁים, וַהֲרֵי לְךָ אֶצְלִי בָּהֶן יָיִן, וְיַיִן אֵין לוֹ:
(1) The Torah states the prohibition against taking interest: “And if your brother becomes impoverished, and his hand falters with you, then you shall support him; whether a stranger or a native, he shall live with you. You shall not take from him interest [neshekh] or increase [tarbit]; you shall fear your God and your brother shall live with you. You shall not give him your money with neshekh and with marbit you shall not give him your food” (Leviticus 25:35–37). The mishna asks: Which is neshekh, and which is tarbit? Which is the case in which there is neshekh? With regard to one who lends another a sela, worth four dinars, for five dinars to be paid later, or one who lends another two se’a of wheat for three se’a to be returned later, this is prohibited, as it is taking interest [noshekh]. And which is the case in which there is tarbit? It is the case of one who enters into a transaction that yields an increase in the produce beyond his investment. How so? For example, one acquired wheat from another at the price of one kor of wheat for one gold dinar, worth twenty-five silver dinars, with the wheat to be supplied at a later date, and such was the market price of wheat at the time he acquired it. The price of one kor of wheat then increased and stood at thirty dinars. At that point, the buyer said to the seller: Give me all of my wheat now, as I wish to sell it and purchase wine with it. The seller said to him: Since it is ultimately wine that you want, not wheat, each kor of your wheat is considered by me to be worth thirty dinars, and you have the right to collect its value in wine from me. And in this case, the seller did not have wine in his possession. If wine then appreciates in value, the result will be an interest-bearing transaction, as the buyer collects from the seller wine worth more than the wheat for which he paid.
(ג) דינר זהב. עשרים וחמשה דינרי כסף:
(3) דינר זהב – twenty-five silver denars.
(א) איזהו נשך ואיזהו תרבית כו': מה שקורא נשך הוא רבית דאורייתא ומה שקראו תרבית הוא רבית דרבנן.
...אָמַר רָבָא: אִי אַתָּה מוֹצֵא לֹא נֶשֶׁךְ בְּלֹא תַּרְבִּית, וְלֹא תַּרְבִּית בְּלֹא נֶשֶׁךְ. וְלֹא חִלְּקָן הַכָּתוּב אֶלָּא לַעֲבוֹר עָלָיו בִּשְׁנֵי לָאוִין...
אָמַר רָבָא: לְמָה לִי דִּכְתַב רַחֲמָנָא לָאו בְּרִבִּית, לָאו בְּגָזֵל, לָאו בְּאוֹנָאָה? צְרִיכִי, דְּאִי כְּתַב רַחֲמָנָא לָאו בְּרִבִּית – מִשּׁוּם דְּחִידּוּשׁ הוּא, דַּאֲפִילּוּ בְּלֹוֶה אָסְרָה רַחֲמָנָא. וְאִי כְּתַב רַחֲמָנָא לָאו בְּגָזֵל – מִשּׁוּם דִּבְעַל כֻּרְחֵיהּ, אֲבָל אוֹנָאָה – אֵימָא לָא. וְאִי כְּתַב רַחֲמָנָא לָאו בְּאוֹנָאָה, מִשּׁוּם דְּלָא יָדַע דְּמָחֵיל.
(א) צריך ליזהר בריבית וכמה לאוין נאמרו בו שהמלוה עובר בששה לאוין:
והלוה עובר בשלשה לאוין
והערב והעדים והסופר עוברים בשני לאוין:
והסרסור וכל המסייע בדבר או המורה מקום ללות או להלוות עוברים בלאו דלפני עור וכו':
(ב) אע"פ שאם לא ילוה המלוה הזה ללוה זה, ילך הלוה הזה וילוה מישראל אחר אפילו הכי עובר המלוה בלפני עור והלוה גם כן עובר, אע"פ דאם לא היה לוה הוא מזה הישראל היה לוה ממנו ישראל אחר. אבל הערב והעדים והסופר אינם עוברים בלפני עור אלא דוקא בעני שאלולי הם לא היה זה המלוה מלוה לזה, אבל אם גם בלעדם היה מלוה אותו אינם עוברים בלפני עור, ורק עוברים על לא תשימון עליו נשך. ואע"ג דאין עוברים בלאו דלפני עור הרי הם מחזיקים ידי עוברי עבירה דיש בזה איסורא דרבנן. והסרסור וכל מי שמסייע בדבר אין בידם אלא איסור דרבנן דמחזיקין ביד עוברי עבירה:
(ג) גם ברבית דרבנן רמו רבנן על המלוה כל איסורי לאוין הנזכר לעיל. אבל על הלוה לא רמו רבנן אלא רק איסור לאו דלפני עור. ויש אומרים דגם העדים אין עוברים ברבית דרבנן אלא רק על איסור דלפני עור ועיין חות דעת בחידושים:
(ד) מן התורה מותר להלוות לנכרי בריבית וללות מהם, דכתיב "לנכרי תשיך". ובזמן התנאים אסרו חז"ל להלוות להם כדי שלא ילמוד ממעשיהם ולא התירו אלא כדי חייו ואח"כ חזרו החכמים ז"ל והתירו הלואה לנכרי בריבית לגמרי אפילו יותר מכדי חייו כדין של תורה. וכל ישראל שמלוה מעותיו לישראל ברבית ותולה אותם בגוי שאומר של גוי הם, הקב"ה יפרע ממנו:
(ה) מומר שיצא מן הכלל מותר להלוות לו ברבית, אבל אסור ללוות ממנו בריבית. מיהו אם זה המומר הוא נכנס בדת ישמעאל, שמודין ביחוד ואין להם שיתוף, אז גם להלוות לו בריבית אסור. וכן הקראים אסור להלוותם בריבית, וכל שכן דאסור ללות מהם:
(י) אפילו אם מלוה ראובן מעות לשמעון ואינו קוצץ עמו הריבית אלא מלוהו בענין שאם ירויח יתן לו ריוח ואם יפסיד יהיה ההפסד כולו על הלוה ונמצא שהמלוה קרוב לשכר ורחוק מהפסד גם בזה אסרו חז"ל:
(טו) אם הלוה בעל מלאכה ועושה למלוה מלאכה בזול יותר מלשאר אדם כדי שירויח לו הזמן הרי זה ריבית של תורה ואם כבר הרויח לו הזמן ואינו תובעו ואחר זה עושה לו בזול הרי זה דבק ריבית ואסור מדרבנן:
(כג) ראובן יש לו חוב על שמעון מאה דנרים לזמן שלשה חדשים מותר לומר לשמעון תפחות מן החוב שלשה דנרים ותתן לי תשעים ושבע דנרים היום והפטר! ואין בזה שום איסור כלל:
